Halle Berry's ex Gabriel Aubry got a temporary restraining order against Halle Berry's fiance Olivier Martinez on Monday, claiming Martinez threatened to kill him before beating him up on Thanksgiving.
And judging by post-brawl pictures Aubry released on Monday, it looks like it wasn't just a threat. So much for the stereotype of the French running from fights. At least one of them seems pretty good at it.
Aubry got the order late Monday, after Berry got her own temporary order against Aubry. Aubry alleges that Martinez threatened to kill him if Aubry didn't let Berry and Martinez move to France with her and Aubry's 4-year-old daughter, Nahla, according to E! News.
Duringan ugly custody battle, a judge earlier this month ruled that Berry can't move her daughter to France. Which apparently didn't please Martinez.
In a court filing obtained by E! News, Aubry alleges Martinez first confronted him last Wednesday outside Nahla's school, saying in French, "I wish I could beat the (expletive) out of you right now. We're going to take Nahla right now and you're not going to follow us." Nahla ended up leaving school with Aubry, as scheduled.
He yelled at him at French? No wonder Aubry thought he could take him.
The next day, Thanksgiving, Aubry alleges he dropped off Nahla at Berry's house when Martinez attacked him. The court filing says, "He continued to punch me at least two or three times, kicked me in the ribs with his knee or foot, and took my head in his hands and slammed it to the concrete driveway." While Martinez was beating on him, Aubry claims Martinez told him, "You cost us 3 million dollars. When you see the judge you're going to go to Paris or I'm going to kill you.'"
I wouldn't go to Paris either if everyone there acts like this Martinez guy.
Aubry also alleges Martinez threatened to kill him if he didn't claim that he attacked Martinez. Aubry supposedly told police Martinez attacked him, but he was handcuffed, put in an ambulance and taken to Cedars-Sinai Medical Center. He was arrested on suspicion of attempted battery.
Aubry's restraining order says Martinez must stay at least 100 yards away from Aubry. Maybe they should have made it farther. A hearing is scheduled for Dec. 17 over whether the temporary order becomes permanent.
Meanwhile, attorneys for both Aubry and Berry were in court Tuesday, arguing over Berry's temporary restraining order against Aubry.
Neither Halle nor Gabriel was in the courtroom, and there's no word on what was said at the hearing, which was closed off to media. Berry's attorney has said they want to make the order -- which specifies that Aubry must stay away from his daughter -- permanent.

Gabriel Aubry, the ex-boyfriend of Halle Berry, claims he suffered a fractured rib, bruises to the face and cuts that required stitches during a Thanksgiving Day altercation with the actress' fiance, French actor Olivier Martinez, at her Hollywood Hills home.

Officers in unmarked cars were seen at the actress' Beverly Hills home to speak to her and her fiance over the fight he had with Halle's ex-boyfriend Gabriel Aubry last week when he returned the former couple's four-year-old daughter Nahla to her mother, RadarOnline.com reports.
Gabriel is expected in court today (27.11.12) to request a judge lift an order prohibiting him from seeing Nahla, and has made a sworn declaration that he did not instigate the fight, but Olivier attacked and threatened to kill him.
In his application for a restraining order against the French actor - which was granted yesterday (25.11.12) - he also asked for security footage to be secured before it was destroyed.
He said: "I told the officers that [Martinez] was the one who attacked me, and repeatedly told them to get the security tapes from Ms. Berry's security cameras before she and Mr. Martinez deleted them."
The 36-year-old hunk claimed in court documents that Olivier said he would kill him if he didn't let Halle move to France with Nahla.
The duo got into a heated fight after which Gabriel was hospitalised for multiple injuries including a broken rib and a swollen black eye before he was later arrested on suspicion of a misdemeanour battery.
Halle immediately secured a temporary emergency protection order against him to keep him at least 100 yards away for her, their daughter and Olivier for 72 hours.
The actress's lawyer has confirmed she plans to ask for the order to be extended this week and a hearing has already been scheduled to decide whether to make it permanent for December 17.

Witness statements by Halle Berry and the family’s babysitter may figure into the determination by city prosecutors on whether to file a criminal charge against Gabriel Aubry in connection with the fight at Halle Berry's home on Thanksgiving Day, law enforcement personnel familiar with the case said.
Los Angeles police booked Aubry on suspicion of misdemeanor battery in connection with the fight between him and Berry's fiance, Olivier Martinez, at the actress' Hollywood Hills home.
Aubrey said he was the victim of an unprovoked physical attack by Martinez, which he contends was not witnessed in a declaration filed in Los Angeles Superior Court in an unsuccessful attempt to have a judge lift a restraining order that Berry has against him.
But Berry and the babysitter for her daughter Nahla witnessed Aubry initiate a fight by pushing and shoving Martinez, according to the law enforcement personnel, who asked not to be named because the investigation was continuing.
Those witness statements factored into the LAPD’s decision to arrest Aubry. They will also be part of any decision by the Los Angeles city attorney on whether to file charges in the case. Officials with the Los Angeles city attorney’s office said they expect the LAPD to bring them the case sometime next week.
Aubry claims he was actually the victim in the incident and sought unsuccessfully Tuesday to have a judge lift a restraining order Berry has against him. Aubry is seeking his own protective order against Martinez, who Aubry contends threatened to kill him, according to court papers.
Since Aubry and Berry split in 2010, the couple have shared custody of their daughter, Nahla, but in 2011, Berry sought permission to move to Paris with Nahla. Los Angeles County Superior Court Judge Mark A. Juhas denied the request this month, setting the stage for the latest fireworks.
Aubry alleges in court papers that during the Thanksgiving fight, Martinez told him to tell the judge in the custody case that "you’re going to Paris or I’m going to kill you." "You’re going to Paris, you’re going to get your 20 grand a month in child support," Aubry’s declaration quotes Martinez as saying.
Martinez then threatened to kill him unless he told police that he said he initiated the altercation, Aubry's filing says. Aubry also claims that during the fight he suffered a fractured rib, bruises to the face and cuts that required stitches.
In an application for a protective order Thursday, Berry asked a judge that Aubry be ordered to stay 100 yards from her daughter and her fiance. Berry alleged Aubry made “verbal threats, caused physical harm to the child’s mother and Martinez.”
Aubry is scheduled to appear in court Dec. 13.
